Historically the law completely prohibited the use of testimonials in physician advertising. In recent years, however, the Illinois court and the legislature have stated testimonials are not inherently misleading and may be used if they do not violate other advertising provisions of the Medical Practice Act.

Rules require that advertisements communicated to the public over television or radio shall be retained for at least three years by the physician. This would include video or audiotape of such promotional material.

It is unlawful to advertise fee comparisons of available services with those of other persons licensed under the Medical Practice Act, although it is permissible to advertise your own usual and customary fees for routine services.
