Microsoft has announced that they will no longer support or issue security patches to the Windows XP operating system after April 8, 2014. Based on the analysis below of the requirements in the HIPAA Security Rule, all Windows XP operating systems must be moved to a newer, supported operating system offering regular updates and security patches.

The Health Insurance Portability and Accountability Act of 1996 (HIPAA) was implemented in four different phases to ensure compliance. The latest portion of HIPAA is the SECURITY RULE, which went into effect on April 21, 2005. All providers, except for small health plans, should have been in compliance by April 20, 2005. The exception for small health plans mandates that they must be compliant no later than April 20 of 2006.

A couple of weeks ago, I received a phone call from one of our clients in obvious distress. He indicated that his server had crashed and low and behold, both of his backups also failed. Not only did he lose three years worth of electronic patient records, but every patient’s billing information, payments, and accounting. He was obviously the most worried about what would happen if any insurance carrier were to ask for records during this period of time. Little did he know, this was only the beginning of his nightmare.
