Both the Illinois Chiropractic Society and I have received numerous calls lately regarding the difficulty in receiving payment under the patient’s MedPay portion of their auto insurance policy.

It appears that when the doctor or office staff submits to the MedPay policy, and the case is ultimately settled or tried, the insurance company sends the check to the Attorney because of Attorney Lien placed on that policy.  Typically, the check is made out in the patient’s name and then placed in an “escrow” account to be part of the overall settlement.  In addition, the Attorney will keep 1/3 of this check.
