Reimbursement of Employee Expenses: Recent Changes to Illinois Law

All physician employers and their employees should be aware that Illinois law now requires employers to reimburse their employees for certain expenditures made in connection with their work. The law applies to all employers, regardless of the number of employees, and to all true employees (but excludes independent contractors. For details as to the differences between an employee and independent contractor, see: INDEPENDENT CONTRACTOR OR EMPLOYEE).

What are the takeaways from the new law? The ICS recommends that physician practices create a written expense reimbursement policy that both complies with the law and adds details that are tailored to the practice. The policy may restate the law by saying that the practice will reimburse only for employee expenses that are required, authorized, and made in conformity with office policy. Similarly, the policy may state that the practice will not reimburse expenses that are not authorized or required by the practice.
