Substance Use Disorder record confidentiality refers to enhanced federal privacy protections for patient information related to substance use diagnosis, treatment, or referral. These rules are governed by HIPAA and federal confidentiality regulations, often referred to as Part 2. Updates to these regulations require covered healthcare practices to have specific written policies, consent language, disclosure tracking, and staff training in place by February 2026. Even practices that do not provide substance use treatment directly most likely will encounter SUD-related information through patient histories or records received from other providers.
