The ICS recommends that physicians look to multiple laws, court cases, network agreements, and other legal authorities to determine how long to maintain patient records. To accommodate all of these standards, the ICS generally recommends maintaining records for a minimum of 10 years from the date of the last encounter for adult patients.
The Illinois Medical Practice Act now specifies the number of years that physicians must retain patient medical records. For adults, the Act requires at least 6 years after the last date of service for each patient, except as otherwise required by law. For minor patients, the Act requires at least 6 years after the last date of service or until the patient reaches the age of 21, whichever date is longer, except as otherwise required by law.
