The following was taken from a 2009 "Illinois Health Law Update" review done by ICS General Counsel.
In a case involving Health Care Service Corporation, operating as Blue Cross Blue Shield of Illinois (BCBSIL), a court found that a patient’s falsification of her application for health insurance justified BCBSIL’s voiding of the policy (Conti v. Health Care Service Corporation, 378 Ill.App.3d 202 (2007)). In this case, the patient had experienced abdominal pain and loss of appetite and went to her internist for a physical examination to look into her symptoms. According to the doctor’s notes, the patient needed certain tests, but the patient had no insurance and the tests were put on "hold.” The doctor prescribed a medication for the patient and told her to call if her symptoms worsened.
